Algemene voorwaarden
Toepassingsgebied:
1.1.
Al onze verkopen, werken, leveringen en diensten, van welke aard ook, geschieden tegen de hierna volgende voorwaarden, met uitzondering van bijzondere voorwaarden, eventueel schriftelijk overeengekomen met de klant.
1.2.
Aanvaarding van deze algemene voorwaarden impliceert dat de klant volledig verzaakt aan de toepassing van zijn eigen algemene voorwaarden.
Prijsoffertes en bestellingen:
2.1.
Onze offertes zijn een maand geldig, behoudens indien anders vermeld.
2.2.
De BTW-bedragen die worden toegepast zijn:
21% voor materiaal, drank, transport en prestaties.
2.3.
De bevestiging van de offerte geldt als bestelbon.
2.4.
Indien een klant een overeenkomst geheel of gedeeltelijk annuleert is zij, als schadevergoeding de volgende annuleringskosten in percentages van het voor het desbetreffende goederen of diensten van Forest To Plate in de overeenkomst het hier verder vermelde bedrag verschuldigd. Drie dagen voor en op de dag(en) van uitvoering van diensten: 85% van totaalbedrag factuur. 14 dagen tot 3 dagen voor de dag(en) van uitvoering: 60% van totaalbedrag factuur. Meer dan 14 dagen voor de dag(en) van uitvoering 35% van totaalbedrag factuur vermeerderd met gemaakte kosten. Bij overmacht (pandemie of extreem noodweer) wordt 35% aangerekend van het totaalbedrag. Gehele of gedeeltelijke annulering van een overeenkomst door de cliënt dient schriftelijk of via mail aan Forest To Plate te geschieden. Voor de vaststelling van de annuleringskosten wordt uitgegaan van de datum van ontvangst van dit schrijven door Forest To Plate .
Betalingstermijn en – modaliteiten:
3.1.
Tenzij partijen schriftelijk anders zijn overeengekomen, zijn de facturen van Forest To Plate betaalbaar uiterlijk 14 dagen na factuurdatum.
Schadevergoedingen en nalatigheidsintresten
In geval van gehele of gedeeltelijke niet-betaling van een factuur op de vervaldag, is de klant van rechtswege en zonder voorafgaande ingebrekestelling, een verwijlintrest verschuldigd van 10% per jaar meer een forfaitaire vergoeding van 10%, met een minimum van 50€.
Bevoegdheids- en rechtskeuzebedingen:
5.1.
Alle overeenkomsten waarop deze algemene voorwaarden van toepassing zijn, alsmede alle andere overeenkomsten die daaruit voortspruiten, worden uitsluitend beheerst door het Belgisch recht.
5.2.
Alle geschillen tussen partijen omtrent overeenkomsten die aan deze algemene voorwaarden zijn onderworpen, behoren uitsluitend tot de bevoegdheid van de rechtbanken van het arrondissement Brussel.
5.3
Forest to Plate is niet aansprakelijk voor gebeurlijke ongevallen/diefstal voor, tijdens en een geboekte activiteit of verblijf

Conditions générales d'utilisation
Champ d'application :
1.1.
Toutes nos ventes, travaux, livraisons et services, de quelque nature qu'ils soient, sont effectués aux conditions suivantes, à l'exception des conditions particulières, éventuellement convenues par écrit avec le client.
1.2.
L'acceptation des présentes conditions générales implique que le client renonce totalement à l'application de ses propres conditions générales.
Offres de prix et commandes :
2.1.
Nos offres sont valables pour un mois, sauf indication contraire.
2.2.
Les montants de TVA appliqués sont les suivants :
21% pour les matériaux, les boissons, les transports et les services.
2.3.
La confirmation de l'offre est considérée comme le bon de commande.
2.4.
Si un client annule tout ou partie d'un contrat, il sera redevable des frais d'annulation suivants, exprimés en pourcentage du montant indiqué dans le contrat pour les biens ou services fournis par Forest To Plate. Trois jours avant et le(s) jour(s) d'exécution 85% du montant total de la facture. Quatorze jours à 3 jours avant le(s) jour(s) d'exécution 60% du montant total de la facture. Plus de 14 jours avant le(s) jour(s) d'exécution 35% du montant total de la facture majoré des frais engagés. En cas de force majeure (pandémie ou conditions météorologiques extrêmes), 35 % du montant total sera facturé. L'annulation totale ou partielle d'un engagement par le client doit être faite par écrit ou par courriel à Forest To Plate. La date de réception de cette lettre par Forest To Plate sera prise en compte pour déterminer les frais d'annulation.
Conditions et modalités de paiement
3.1.
Sauf accord écrit contraire entre les parties, les factures de Forest To Plate sont dues au plus tard 14 jours après la date de facturation.
Indemnité et intérêts moratoires
En cas de non-paiement d'une facture, en totalité ou en partie, à la date d'échéance, le client sera redevable, de plein droit et sans mise en demeure préalable, d'intérêts de retard au taux de 10% l'an, avec un minimum de 50 €.
Clauses de compétence et de choix de la loi :
5.1.
Tous les contrats auxquels s'appliquent les présentes conditions générales, ainsi que tous les autres contrats qui en découlent, sont exclusivement régis par le droit belge.
5.2.
Tous les litiges entre les parties concernant les accords soumis aux présentes conditions générales sont soumis à la compétence exclusive des tribunaux de l'arrondissement de Bruxelles.
5.3
Forest to Plate n'est pas responsable des accidents/vol qui peuvent survenir avant, pendant et après une activité ou un séjour réservé.

General Terms and Conditions
Scope:
1.1.
All our sales, works, deliveries and services, of any kind, shall be made on the terms and conditions set out below, except for any special terms and conditions agreed in writing with the customer.
1.2.
Acceptance of these general terms and conditions implies that the customer completely waives the application of his own general terms and conditions.
Price quotations and orders:
2.1.
Our quotations are valid for one month, unless otherwise stated.
2.2.
The VAT amounts applied are:
21% for material, beverage, transportation and services.
2.3.
The confirmation of the quotation is considered to be the order form.
2.4.
In the event that a client cancels a contract, either in whole or in part, she will be liable for the following cancellation charges as a percentage of the amount stated in a contract for the relevant goods or services provided by Forest To Plate, as compensation. Three days before and on the day(s) of execution 85% of total invoice amount. Fourteen days to 3 days before the day(s) of performance 60% of total invoice amount. More than 14 days before the day(s) of execution 35% of total invoice amount increased by costs incurred. In case of force majeure (pandemic or extreme weather), 35% of the total amount will be charged. Total or partial cancellation of an engagement by the client must be made in writing or by email to Forest To Plate. The date of receipt of this letter by Forest To Plate will be taken as the basis for determining the cancellation fee.
Payment term and modalities:
3.1.
Unless otherwise agreed in writing by the parties, Forest To Plate's invoices are payable no later than 14 days after the date of invoice.
Indemnity and default interest
In the event of non-payment of an invoice, in full or in part, by the due date, the customer will be liable, automatically and without prior notice, to pay default interest at the rate of 10% per annum, with a minimum charge of € 50.
Jurisdiction and choice of law clauses:
5.1.
All agreements to which these general terms and conditions apply, as well as all other agreements resulting from them, shall be governed exclusively by Belgian law.
5.2.
All disputes between parties concerning agreements that are subject to these general terms and conditions shall be subject to the exclusive jurisdiction of the courts of the district of Brussels.
5.3
Forest to Plate is not responsible for accidents/theft that occur before, during and after a booked activity or stay.
